Patna High Courts orders termination of a minor rape victim`s pregnancy

Patna: Patna High Court today ordered the director of All India Institute of Medical Sciences (AIIMS) in the state capital to terminate the pregnancy of a minor rape victim without charging any fees as the life without dignity could not be imagined.

After hearing arguments of both sides on a petition filed by the rape victim praying for termination of her pregnancy, Justice Dinesh Kumar Singh also asked Patna AIIMS director to ensure that the petitioner was provided all medical assistance including food and lodging along with one attendant until she was fully cured.

The court also directed district legal services authority, Saran to give interim compensation and final compensation keeping in view the upper limit of Rs 3 lakh fixed in Bihar Victim Compensation Scheme, 2014 on conclusion of trial.
The court also asked DLSA to provide a competent lawyer to appear on behalf of the petitioner before the trial court.

“The ‘best interest test’ requires the court to ascertain the course of action which would serve the interest of the person in question.
